This volume is the result of a thorough exploration of contemporary conceptions of romantic love from different points of view. Beginning with an initial text where the meanings of romantic love are discussed theoretically and historically, the contributions gathered here present current discussions about love in the present day and in different geographical contexts that range from Hungary to Italy or Spain. The first part of the book is devoted to the analysis of mobilities for the sake of love as (...) a result of globalization. These mobilities are analysed in relation to love ideals, to gender equality and to online searches for the ideal partners. The second part of the book deals with the exploration of different imaginaries of love in particular geographical contexts. The topics dealt with here include love as sickness, love and violence, love ideals for men engaged in gender equality and love ideals for those who engage in cross-dressing practices. In the third part, writing about and for love is addressed. Love writings to the beloved dead, teenage girlsâ (TM) blogs and bestsellers such as Fifty Shades of Grey are discussed in particular detail. This book addresses current conceptions of romantic love in different social groups through different practices and in different countries, and shows that, despite the variability of discourses, experiences and practices related to love, a number of ideas of what love should be like â " related to the Western ideals of romantic love â " persist in all these contexts. The contributions to this volume are derived from extensive fieldwork and ethnographic research, and will be of undoubted interest for the academic milieu. However, given the topic it deals with, the book will also appeal to the general public, who will find in these pages many â ~love storiesâ (TM) derived from the detailed study of the society which we inhabit and the ideals of love that we breathe. This article puts forward solutions to some of the ethical and legal dilemmas posed in the current discussion on how to program crash algorithms in autonomous or self-driving cars. The first part of the paper defines the scope of the problem in the criminal legal field, and the next section gives a critical analysis of the proposal to always prioritise the interest of the occupant of the vehicle in situations with conflict of interests. The principle of minimizing social damage as (...) a model for configuring self-driving cars is examined in the third section. Despite its apparent plausibility, within the framework of a liberal legal system that recognises humans as free agents who have rights and responsibilities, maximizing the function of social utility does not justify harmful interference into a person’s legal sphere. Therefore, in the fourth part, the author argues the need to program the crash algorithms of autonomous cars based on a deontological understanding of the system of justifications in criminal law. The solution to the dilemma lies in a prior analysis of the legal positions of all agents involved in the conflict, from a perspective of the principles of autonomy and solidarity as the core of the system of justifications. Noël Carroll denies and Robert Stecker affirms that it is a necessary condition of aesthetic experience that it should be valued for its own sake. I make use of their controversy to argue for the psychological impossibility of discharging very common practices of art evaluation and analysis without undergoing an aesthetic experience valued for its own sake. By way of supporting my thesis and also making progress in Stecker and Carroll’s dispute about aesthetic experience, I analyse their methodological assumptions and (...) develop further our understanding of negative, indifferent and unexpected aesthetic experiences. The article provides a defence of Stecker’s position based on my contention regarding art evaluation and analysis. (shrink)

In this article I argue that a high capacity for courage, in the sense of the strength of character that enables one to face distress, angst or psychological pain, is required of Hume’s ideal critics just as the other well-known five characteristics are. I also explore the implications of my proposal for several aspects of Hume’s aesthetics, including the one brought into relief by Shelley’s interpretation of Hume along the lines of distinguishing between the perceptual and affective stages in aesthetic (...) appreciation. Recently, the mechanistic framework of active inference has been put forward as a principled foundation to develop an overarching theory of consciousness which would help address conceptual disparities in the field (Wiese 2018 ; Hohwy and Seth 2020 ). For that promise to bear out, we argue that current proposals resting on the active inference scheme need refinement to become a process theory of consciousness. One way of improving a theory in mechanistic terms is to use formalisms such as computational (...) models that implement, attune and validate the conceptual notions put forward. Here, we examine how computational modelling approaches have been used to refine the theoretical proposals linking active inference and consciousness, with a focus on the extent and success to which they have been developed to accommodate different facets of consciousness and experimental paradigms, as well as how simulations and empirical data have been used to test and improve these computational models. While current attempts using this approach have shown promising results, we argue they remain preliminary in nature. To refine their predictive and structural validity, testing those models against empirical data is needed i.e., new and unobserved neural data. A remaining challenge for active inference to become a theory of consciousness is to generalize the model to accommodate the broad range of consciousness explananda; and in particular to account for the phenomenological aspects of experience. Notwithstanding these gaps, this approach has proven to be a valuable avenue for theory advancement and holds great potential for future research. (shrink)

Objetivamos elaborar um balanço sobre lógica das perguntas científicas na produção do conhecimento stricto sensu. Tomamos como fontes 100 dissertações e 32 teses escritas por docentes que trabalham em cursos de Educação Física no Estado da Bahia – 1982 a 2018, abordando enquanto objeto a lógica instituída pelas perguntas científicas na referida produção. Trata-se de uma pesquisa documental, tendo como método o materialismo histórico e dialético. Os resultados apontam que 48% das produções têm suas perguntas de investigação construída a partir (...) da lógica formal; 28% apresenta uma lógica dialética na elaboração das perguntas científicas; e 24% não apresentam problema de investigação. ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. The necessity defense is barely accepted in contemporary Western case law. The courts, relying on the opinion held by the majority of legal scholars, have reduced its margin of application to practically zero, since in the framework of contemporary welfare states, there is almost always a “legal alternative.” The needy person who acts on their own behalf, regardless of whether they save an interest higher than the one they injure, does not show due deference to democratic legal solutions and procedural (...) channels. This article aims to contest this abrogative interpretation of the necessity defense and to outline the limits of its legitimate scope. Even in welfare states, there are actions in a necessity scenario that neither question the legal decisions of the democratically elected legislature nor make a mockery of established procedural channels. Faced with the inaction of liberal democracies to effectively tackle global warming, many climate activists engage in forms of protests that involve committing minor criminal offences. They seek to shape official decisions on climate policies by resorting to civil disobedience. Some of these activists, rather than accepting punishment, have successfully claimed to be acting in a justified manner by invoking the necessity defence. The aim of this article is to show that, within the framework of representative democracies guided by the (...) rule of law, the climate necessity defence must be rejected, since such protests do not meet the ‘non-legal alternatives’ requirement. This does not mean, however, that protesters should be punished as common offenders. Their acceptance of responsibility and political motivation should be taken into account as a mitigating factor at sentencing. (shrink)

Para ello, primero enmarcaré la discusión dentro de la interpretación heideggeriana del naturalismo y su manera de entender la relación entre filosofía y ciencia. Luego, analizaré su interpretación de la embriología y la ecología mediante la cual Heidegger esboza aportes originales a la filosofía de la biología, especialmente en torno al problema de la identidad del organismo biológico. Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

Among the advocates of expressive theories of punishment, there is a strong consensus that monetary fines cannot convey the message of censure that is required to punish serious crimes or crimes against the person. Money is considered an inappropriate symbol to express condemnation. In this article, I argue that this sentiment is correct, although not for the reasons suggested by advocates of expressivism. The monetary day-fine should not be understood as a simple deprivation of money, but as a punishment that (...) reduces the offender’s capacity to consume for a certain period of time. Conceived in this manner, I argue that it is perfectly suitable to convey censure. However, the practical impossibility of ensuring that the person who pays the fine is the same person who has been convicted of the offense seriously undermines the acceptability of the monetary fine as an instrument of censure. Minimizing the risk of the fine’s hard treatment being transferred to third parties is a necessary condition for the monetary fine to be considered a viable alternative to lengthy prison sentences. To become a unifying theory of brain function, predictive processing must accommodate its rich representational diversity. Gilead et al. claim such diversity requires a multi-process theory, and thus is out of reach for PP, which postulates a universal canonical computation. We contend this argument and instead propose that PP fails to account for the experiential level of representations.

For Kierkegaard, seduction can no longer be (...) described or conceived of as an exclusively aesthetic undertaking, as the sheer fulfillment of pleasure and desire, as the factual consolidation of immediacy and sensuousness, but, on the contrary, seduction must be redescribed and reconceived within the realm of ethics or, to be more precise, within the confinium or border area between ethics and aesthetics. In this sui generis no-man's-land, which to a certain extent is formally inaugurated and categorially established by the notion of aesthetic action, as we will see--resides the ethical seduction.In effect, such a reconception of seduction presupposes an organic and dialectic recomprehension of the well-known Kierkegaardian theory of the stages, according to which any significant relation between the aesthetic and the ethical is not grounded on the evident divergences between both but, on the contrary, on their coadjuvancy. The point is that neither the aesthetic nor the ethical can or should be understood if disconnected, if incommensurably read, if seen only in the light of (an) Either/Or [E/O 1, 2].Forged within the aforementioned ambivalent frame, the Kierkegaardian figure of seduction becomes more than just a category, a sheer theoretic or analytic tool to reflect upon existence: it becomes a literary strategy as well, of philosophical and specifically ethical signification.Through an examination of some texts of E/O 1 (especially "The Seducer's Diary") and of Kierkegaard's journals and papers, I will pursue a typology of seduction with three modes: the musical seduction, or Don Juan's; the linguistic seduction, or Faust's; and the literary seduction, or Johannes's. The johannesque seduction will be stressed as the first janus frontis of the dilemma between the aesthetic and the ethical stages, to blur the conventional differences between both. Then I will bring Johannes, the seducer, and A, the aesthete, close to each other in order to illuminate what might be understood as [End Page 78] the aesthetic action. It will be argued that the aesthetic can no longer be deprived of all pragmatic connotations. Therewith, not only are the limits or chiasm between aesthetics and ethics blurred, but a common categorial space is established. The paradigmatic action in this context will be the johannesque actio(nes) in distans, that is, the second janus frontis of our dilemma. Finally, I will briefly consider Søren Kierkegaard's own aesthetic action or actio(nes) in distans, that is, his own literary practice. Seducers: Don Juan and Faust A typological consideration of the figure of seduction in E/O 1 quickly makes it clear that Kierkegaard's main source of inspiration, or rather of conceptual kleptomania, is to be found in Romanticism. 1 In this spirit, A, the aesthete, would let himself be brought from reflection to reflection, from insight to insight, and from glimpse to glimpse, by the experienced guiding hands of (his colleagues) Don Juan and Faust.In 1836, several years before the publication of E/O, where Don Juan and Faust are characterized as and related to the phenomenological realm of the demonic (det dœmoniske), Kierkegaard significantly writes in his journals that both cases, or figures, incarnate two "ideas," that is, two paradigmatic vital ideals or even two conceptions of life, which take shape "beyond the religious" [Pap I A 150]. 2 Consequently, seduction presupposes a nonreligious conception and/or way of life. It seems unclear, however, whether seduction presupposes, as Judge Wilhelm claims it does, a full rejection of the ethical. El aumento en la producción y consumo de frutas y hortalizas mínimamente procesadas de los últimos años ha con­tribuido a incrementar las toxiinfecciones alimentarias asociadas al consumo de productos vegetales frescos. Esto es debido a que los tratamientos desinfectantes llevados a cabo actualmente por industria de IV gama son insuficientes para garantizar la seguridad microbiológica de los productos finales, y además estos no reciben ningún tratamiento capaz de eliminar todos los patógenos antes de su consumo. Por lo tanto, es necesario (...) utilizar estrategias al­ternativas para reducir los microorganismos patógenos y alteran­tes en frutas y hortalizas. La bioconservación, mediante el uso de microorganismos o sus metabolitos, es una alternativa que, en combinación con las prácticas habituales, puede reducir o prevenir el crecimiento de patógenos en productos mínimamente procesa­dos, mejorando su calidad microbiológica. This paper intends to identify the functions of the French particle “comme” (“like” in opposition to “as”) and “comme si” (“as if”) in the work of French contemporary philosopher Jean-Luc Marion, especially in L’idole et la distance (American translation: The Idol and Distance), Dieu sans l’être (American translation: God without Being), Étant donné (American translation: Being given) and De surcroît (American translation: In excess). The author of this paper focuses on the relation between phenomenology and theology in order to demonstrate (...) its complexity by an analysis of linguistic phenomenology. At the end of this analysis, the “saturated phenomenon”, as proposed by Jean-Luc Marion, becomes an important notion to understand the boundaries of both disciplines, phenomenology and theology. In this paper we state that, up to now, scholars have read the Husserliana—that is Husserl’s official texts—only partially. This statement must be considered within the History of phenomenology and, more precisely, with-in the history of Husserlian studies: from Heidegger to Jean-Luc Marion, including Levinas, Ingarden, Sartre, Merleau-Ponty and so on, Husserl’s texts have been read only partially. With the exception of some analysis proposed by Derrida—or, nowadays, by Natalie Depraz or Elianne Escoubas—, and as far as I know, all (...) the interpretations of Husserl’s texts have considered them just as a support to ex-pose theories or to describe phenomena, but not in themselves, that is, not as texts. Our aim here is then to propose a new perspective to to phenomenalize Husserliana as a text and focus precisely on Husserl’s praxis of writing. Here we will develop specially an analysis of one mode of writing used in Husserl’s praxis of writing and called: bildliche Rede. We will finally compare the results of our analysis to Heidegger’s and Jean-Luc Marion’s praxis of writing.Podem afirmar que, fins avui, els in-vestigadors han llegit la Husserliana —és a dir, els textos de Husserl publicats de manera ofici-al— només parcialment. Cal considerar aquesta afirmació en el marc de la Història de la feno-menologia i, més precisament, en el marc de la història del estudis husserlians: des de Heidegger fins a Jean-Luc Marion —més de cent any de fenomenologia—, els textos de Husserl han estat considerats només com a suport per a exposar teories o descriure fenòmens, però no s’han considerat en ells mateixos, és a dir, no com a textos. Posant en pràctica l’acció de “llegir fenomenologia” en un nou sentit fort del verb “llegir”, aquest article comença identificant els diferents modes de la praxis d’escriptura de Husserl. Després ens concentrarem en un d’aquests modes d’enunciació, anomenat “bildliche Rede”, per desenvolupar així una història de la figurativitat. In order to explore the political and transformative potential of bodies in relation to gender and affects, I discuss how bodies, gender and politics are entangled through the figuration of ‘overflown bodies’. Departing from a material-discursive feminist conceptualisation of bodies, ‘overflown bodies’ are assemblages embedded in complex relationships of matter, discourse, emotions, affects, ideologies, protest, norms, values, relations, practices, expectations and other possibilities of (for) social and political action. Three ethnographic cases illustrate how ‘overflown bodies’ assemble matter and discourse, and (...) how matter, bodies and gender matter. They are used to explore the political possibilities of gendered bodies and show how matter is entangled, embedded and assembled with our politics of being. The three cases interrogate the limits and boundaries of bodies and the modes and modalities of (political) agency. Finally, the article argues that it is through visibility and recognition that ‘overflown bodies’ become critically and creatively transforming, which can be useful for addressing issues related to exclusion, domination, political emancipation and social transformation. Nowadays, consumer ethics represents a relevant field of review. There have been some attempts to conduct literature reviews; however, these have been few and incomplete. For this reason, this paper follows two main objectives: (1) to develop a performance analysis to measure the impact/perceptibility of academic production on consumer ethics (most cited authors, journals and themes) and (2) to visually present the scientific structure by themes of research in consumer ethics as well as its evolution along time. Using SciMAT software, (...) a comprehensive thematic review is discussed. 568 scientific papers (2569 keywords and 8642 citations) were retrieved from the Web of Science from 1995 to 2021 (May). Our results show three main periods with two main research themes (consumer and corporate social responsibility), which remain relevant themes at the time. Also, some new themes that promote ethical consumption have gained weight or appear over time, some of which are linked to the marketing field (such as experiences, satisfaction, attitudes or privacy among others). Instead of the usual apologetic treatment found in legal doctrine, linked to the determinacy, immutability or predictability of norms, this book treats legal certainty innovatively, holistically and in depth. Using a method at once analytical and functional, Professor Ávila examines the structural elements of legal certainty, from its definition and foundations to its various dimensions, normative forces and efficacies, citing a wealth of examples from case law to support each of the theses defended.
